An even dozen: That's how many innocent people in Dallas County have been sent to prison in the last two or three decades, at least based on DNA tests. That's more than any other county in the country. Last week, James Waller was the latest convicted sex offender in Dallas County to be exonerated of a crime, one that sent him to prison for 30 years.

Expect that dozen to grow.

But the dark cloud that the appalling numbers have cast over the Dallas District's Attorney's Office could have a silver lining. It could be the push needed to pass legislation to create an independent statewide Innocence Commission proposed by state Senator Rodney Ellis. His proposal has twice failed to get approval from the Legislature. A source with Ellis' office said the bill will be filed again this week, with a hearing probably taking place within a month.


Baumgartner Court Suppressing Constitution

The Gulag system of the Soviet Union has become primarily known as a place for political prisoners and as a mechanism for repressing political opposition to the Soviet state.

As the scenario continues to unfold in the Elsebeth Baumgartner free speech case in northern Ohio, it appears that the Gulag system has extended into the penal system of Ohio, particularly in Ottawa, Cuyahoga and Erie Counties.

Embattled disbarred attorney and judicial whistleblower Elsebeth Baumgarter, currently serving a 120-day contempt charge for statements made in legal pleadings which are protected by absolute immunity, is scheduled to stand trial on Jan. 29 in Erie County on charges that she stole her own corporate vehicle, resisted arrest and engaged in felony fleeing.

Throughout the more than two year prosecution of Baumgartner, the man in the center of the malicious and convoluted prosecutions has been Daniel Kasaris (left), an assistant prosecutor in the Cuyahoga County prosecutor's office of William Mason and former assistant in the office of Kevin Baxter (right), Erie County prosecutor.


Five Rules

Each of these five rules is fundamental and works to dictate an auctioneer's success, but all of them are also often overlooked by auctioneers, who pay a price for doing so.

Rule No. 1. Limit your business to serving good sellers with good assets to sell. Auctioneering success stems from selecting the right sellers with whom to do business.

If you think this rule is so elementary that it is hardly worth stating, you're wrong. Of all the problems that affect auctioneers, the great majority of them come from the sellers they represent. Nothing else is even close. That's why this topic can never be overemphasized.

Auctioneers are businesspeople, and businesspeople are in business to get and do business. My point that auctioneers should limit their business to accepting only good sellers is often a lot easier said than done.
